Bail in immigration detention: practical points

Prospects of bail usually turn on accommodation, risk and the paper trail — not on eloquence alone.

Applications for immigration bail require a clear picture of where the person will live, who will support them, and why detention is no longer justified. Missing accommodation evidence is still one of the most common reasons applications fail or are adjourned.

Medical material, vulnerability indicators and the history of compliance with reporting also matter. Those documents need to be obtained early; they rarely appear of their own accord on the day of the hearing.

We assist with assembling that evidence and preparing the application so that instructed counsel can focus on the argument.
